I. Contract Formation This written confirmation constitutes a binding contract for both parties regarding the rental of a holiday apartment by Namasté Homes GmbH. Subletting or re-letting is not permitted. Should the apartment be uninhabitable at the time of rental due to force majeure, no compensation will be provided. II. Maintenance of the Holiday Apartment We always strive to provide you with a flawless apartment. Should you find any damage caused by previous tenants, please notify us immediately on the day of arrival so that it can be remedied without delay. Damage or missing inventory items caused by the guest or their travelling companions must be reported to us immediately for damage settlement. Unreported damage or missing items will be invoiced to the tenant retrospectively. III. Pets and Smoking The holiday apartments are non-smoking properties. Pets are not permitted in the holiday apartment. IV. Final Cleaning Final cleaning by the provider is included within the usual scope. Final cleaning does not include washing kitchen utensils, loading the dishwasher, or disposing of rubbish – these remain the responsibility of the guest. V. Payment The full rental price is due immediately upon receipt of the written booking confirmation. For last-minute bookings, payment is to be made immediately or upon arrival, as specified in the booking confirmation. If no payment is made following a payment request, the landlord is entitled to withdraw from the contract. In this case, the cancellation fees set out in Section VI apply. The rental price includes all ancillary costs, e.g. energy costs, final cleaning, bed linen, and towels. VI. Cancellation Cancellations must be submitted in writing to the landlord. Cancellation is free of charge up to 5 days before the guest's planned arrival. If cancelled within 5 days of arrival, the full rental price becomes due. In the event of a no-show on the day of arrival without prior cancellation, the guest is required to pay the full agreed rental amount. The landlord reserves the right to re-let the unused holiday apartment to another party where possible. VII. Final Provisions The conditions defined in the house rules apply in general. The tenant accepts these conditions and the fees applicable in the event of violations. The personal data provided by the guest at the time of booking will be processed and stored electronically by the landlord. The data will not be passed on to third parties. The law of the Federal Republic of Germany applies exclusively. The place of jurisdiction for all disputes is Würzburg. Statutory regulations apply in all other respects. Should any of the above provisions be or become invalid or void, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a provision that most closely reflects the purpose of the provision being replaced.
